Midnight Gothic Decor - Sales Terms and Conditions
These Sales Terms and Conditions apply only to customers who are consumers.
These Sales Terms and Conditions (together with any other documents referred to herein) explain the terms and conditions on which Midnight Gothic Decor ("Midnight Gothic Decor", "we", "our", and "us") supply our online service for orders of goods placed via our website (www.midnightgothicdecor.com) (our "Site").
Please read these terms and conditions carefully before you submit your order, as they apply to all orders you place. By placing an order with us, you agree to be bound by these terms and conditions. If you do not accept these terms and conditions, you should not place an order.

In addition to these terms and conditions, your use of the Site and any orders you place are subject to our Terms of Use and Privacy Policy. Please read these carefully as they contain important terms which apply to you.
1. The Contract Between Us
1.1 Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.
1.2 We will send you an order confirmation, assigning an order number to your order. This will help us if you need to contact us regarding your order.
2. Price
2.1 The prices payable for goods that you order are as set out on the product pages of our Site (exclusive of VAT).
2.2 If your order is under 70, you will be required to pay for delivery. If your order exceeds 70, shipping will be free. Additional delivery charges will apply if you require special delivery or delivery to remote areas. We are unable to deliver to certain locations, including but not limited to: remote areas in the United States (such as Alaska, Hawaii), UK overseas territories (such as the British Indian Ocean Territory, British Virgin Islands, Guernsey, Jersey), Puerto Rico, Guam, APO/FPO military addresses, and other outlying islands.

3. Our Goods
3.1 The images of our goods on our Site are for illustrative purposes only. Many of our items are handmade, and may differ slightly from the images. While we have made every effort to display the colours and quality accurately, we cannot guarantee that the colour and quality displayed on your device will exactly reflect the colour of the products.
3.2 Due to slight differences from processing, minor colour or finish differences in the goods will not cause the goods to be considered of unsatisfactory quality.
3.3 Defects caused by normal wear and tear, wilful damage, negligence, exposure to sunlight, failure to follow care instructions, or any misuse of the goods will not cause the goods to be considered of unsatisfactory quality.
4. Order Cancellation and Refund/Return Policy
4.1 Before Order Shipment
If your order has not yet been shipped, you can request a full refund at any time. You will receive a shipping confirmation email when your order is shipped. If you have not received this email, it means your order has not yet shipped.
4.2 After Order Shipment
You may request a refund or return within 14 days of receiving your item ("Refund Period").
4.3 Refund/Return Eligibility
a. Damaged and Faulty Items
If your package is severely damaged upon arrival, we will provide a refund or exchange service. Please inspect your order upon receipt, and if you find any defects, damage, or you have received the wrong product, please contact us immediately so we can assess the issue and proceed with a resolution. Claims must be made within 14 days of receiving the package. Please note that damage due to normal wear and tear is not covered under this policy.
b. Incorrect or Missing Items
If you receive an incorrect item (such as the wrong colour, size, etc.), we will offer a refund or exchange service. However, if the size matches your order, we will not accept a return or refund. Please carefully choose the correct size according to the product description.
4.4 Return Eligibility
To be eligible for a return, the item must be in its original condition when you received it, unworn, unused, with tags, and in its original packaging. You must also provide a receipt or proof of purchase.
4.5 How to Start a Return
To initiate a return, please contact us at contact@midnightgothicdecor.com, providing your order number, the reason for the return, and product photos. You must contact us within 14 days of receiving the item to request a return or refund. We will guide you on how to proceed. We will process your refund within 30 days of your receiving the product.
4.6 Non-Returnable Items
We cannot accept returns or refunds for the following items:
a. Buyer does not like the product or size;
b. Minor differences in the product from the image, or defects caused by normal use, wilful damage, negligence, exposure to sunlight, failure to follow care instructions, or other improper use;
c. Product has an odour;
d. Buyer ordered the wrong product or SKU;
e. Incorrect delivery address provided;
f. Product differences were agreed upon in advance;
g. Tracking information deleted by the shipping company or local post office;
h. In certain cases, due to customs clearance failures in some countries, the package may be returned, lost, or seized.
4.7 Refund Process
After we receive and review your return, we will notify you if your refund is approved. If approved, the refund will be processed to the original payment method within 10 business days. Please note that your bank or credit card company may take additional time to process and post the refund. If your return has exceeded 15 business days, please email contact@midnightgothicdecor.com for assistance.
5. Our Right to Cancel Orders
5.1 We reserve the right to cancel the contract between us if:

Insufficient Stock: We do not have enough stock to deliver the goods you have ordered;

Delivery Not Available: We do not deliver to your area;

Incorrect Price: One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
5.2 If we cancel your contract, we will notify you by email and refund any amount we have charged you, within 30 days of your order.
6. Delivery of Goods
6.1 We will deliver the goods you have ordered to the address you provided at the time of ordering.
6.2 You can refer to our Shipping Policy for estimated delivery dates, where we have listed the estimated delivery times for different countries and regions. Please note that these dates are only estimates and we cannot guarantee delivery by those dates. Goods will be shipped within 30 days of order confirmation.
6.3 Once goods have been delivered to you, the risk of loss or damage will transfer to you, and we will not be liable for their loss or destruction.
6.4 You will become the owner of the goods when we have received full payment for the goods.
7. Liability
7.1 If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. However, we are not responsible for any loss or damage that is not foreseeable.
7.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors, for fraud, or for breach of your legal rights in relation to the products.
7.3 We only supply our goods for domestic and private use. If you use our goods for any commercial, business, or resale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
8. Notices
8.1 Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing by email to contact@midnightgothicdecor.com, and all notices from us to you will be displayed on our Site from time to time.
9. Force Majeure
9.1 We will not be liable for any failure to deliver goods or any delay in delivery or for any damage or defect to goods caused by any event or circumstance beyond our reasonable control, including, but not limited to, strikes, lockouts, network failures, floods, fires, explosions, accidents, war, or changes in customs regulations.
10. Invalidity
10.1 If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you), the enforceability of any other part will not be affected.
11. No Waiver
11.1 If we do not immediately insist that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breach of this contract, this does not mean that you do not have to do those things, nor will it prevent us from taking steps against you at a later date.
12. Dispute Resolution
12.1 If you wish to make a complaint in relation to goods you have purchased online, please email contact@midnightgothicdecor.com.
13. Entire Agreement
13.1 These Terms and Conditions, together with the current Site prices, delivery details, contact information, and privacy policy, constitute the entire agreement between us relating to the supply of goods to you. No statement made by any salesperson on our behalf should be understood as a variation of these terms or as an authorized representation about the nature or quality of any goods sold by us. Except for fraud or fraudulent misrepresentation, we will not be liable for any such representations being untrue or misleading.
